Alameda Mayor Trish Spencer’s husband has filed a claim against the city and its police department over a DUI arrest that occurred on St. Patrick’s Day.
The mayor’s husband, Joel Spencer, says he was stopped without probable cause and arrested on a false charge of drunk driving. He pleaded not guilty on April 18, but the criminal case against him is still pending. Spencer is now seeking compensation for bodily injuries, character defamation and the costs of the criminal proceeding.
The city has 45 days to respond before Spencer can filed a lawsuit. City Attorney Janet Kern says the city is waiting to see how the criminal case plays out.
“We are a little puzzled,” Kern said. “Frankly, I don’t know why they decided to file this now.”
