Trial Begins in Santa Cruz County et al v. Bureau of Cannabis Control et al

Last year, the Bureau of Cannabis Control issued new rules that allow cannabis deliveries statewide, including in jurisdictions that have banned commercial marijuana. Twenty-four California cities plus Santa Cruz County are now officially battling the issue in court.

The trial began on August 6 and resulted in an initial win for the state. “In a potential setback for at least some of the cities, the judge tentatively sided with the state in questioning whether some of the communities have standing to bring legal action, because they do not have local ordinances in place that conflict with the state regulation,” the North Bay Business Journal reports. Another hearing is scheduled for November. 

The plaintiffs in the suit are Agoura Hills, Angels Camp, Arcadia, Atwater, Beverly Hills, Ceres, Clovis, Covina, Dixon and Downey. Also participating are McFarland, Newman, Oakdale, Palmdale, Patterson, Riverbank, Riverside San Pablo, Sonora, Tehachapi, Temecula, Tracy, Turlock and Vacaville, and Santa Cruz County. They are being supported by the League of California Cities. You can read their original complaint here.
